The Organic Act of 1863 section 3 gave the Secretary of the Territory, in the case of the governor death, removal, resignation or absense from the territory, the authorization and requirement to execute and perform all the powers and duties of the governor during such vacancy or absence.

I am satisfied that your appointment will be acceptable to the people of the Territory, and that you will fill the place creditably to yourself and to the administration.

He declined the offer.
Donaldson wrote ‘his temptation to accept the honor was very strong. One of the most alluring reasons was the visionary gratification to be mine when I should succeeded Brayman and then have the pleasure of telling him that I was the young soldier with whom he had refused to dine at Cairo, Illinois, many years before. Heroics of the kind do not affect me much. Brayman had forgotten the incident probable for the reason that bad manners were habitual with him. All in all, I do not wonder that he was a failure as a governor. He was too old to affiliate with the Westerners, and he lacked ordinary tact and manners.’
